The Feintool Group (hereinafter “we”, “us” or “Feintool”) takes data protection very seriously. We would therefore like to inform you below about the processing of your personal data on this website.

b. Your rights
If the EU General Data Protection Regulation (GDPR) applies to you, you may exercise the following rights in accordance with the provisions of the GDPR:

  • – Right of access by data subject: You have the right, under certain conditions, to obtain information about which data we hold about you and for what purpose (Art. 15 GDPR)
  • – Right to rectification: You have the right to have inaccurate personal data corrected (Art. 16 GDPR)
  • – Right to restriction of processing: You have the right to obtain restriction of the processing of your personal data (Art. 18 GDPR)
  • – Right to erasure (“Right to be forgotten”): You have the right to have your personal data stored by us erased (Art. 17 GDPR)
  • – Right to data portability: You have the right to receive the personal data concerning you which we hold in a machine-readable format (Art. 20 GDPR)
  • – Right to object: You have the right to object to the processing of your personal data (Art. 21 GDPR)

Where the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time with effect for the future. The lawfulness of processing carried out on the basis of the consent up to the time of withdrawal remains unaffected.
If the Swiss Federal Act on Data Protection (DSG) applies to you, you may exercise the following rights us in accordance with the provisions of the DSG:

– Right of access (Art.s 25 et seq. DSG)
– Right to data disclosure and data transfer (Art.s 28 et seq. DSG)
– Right to rectification, blocking and deletion of your data (Art. 32 DSG)

To exercise any of your rights listed above, you can contact us at any time. The contact details can be found in section I.a.
If you believe that we are processing your personal data in an unlawful manner, please contact us or our Data Protection Officer using the contact details provided above. You also have the right to lodge a complaint with a data protection supervisory authority of your choice.

c. Right to object
You have the right, on grounds relating to your particular situation, to object at any time to the processing of your personal data which is based on Art. 6(1)(f) GDPR. We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests in protection, or the processing serves the establishment, exercise or defence of legal claims. You may object to the processing of your data for direct marketing purposes, including any related profiling, at any time without giving reasons.

d. Storage period
We only store your personal data for as long as it is necessary to achieve the purposes stated in this Privacy Notice or as provided for by the various statutory retention periods. Once the respective purpose no longer applies or these periods have expired, the corresponding data will be routinely blocked or deleted in accordance with the statutory provisions.

e. Recipients
We only disclose your personal data to entities that require your data in order to fulfill our tasks. Depending on the respective processing situation, your personal data is processed not only by us but also by third parties. Possible recipients include, in particular, processors (e.g. web hosting providers, software providers and other technical and IT service providers) or other independent providers of their own services and support services, as well as third-party providers of online services and content. Your personal data may also be disclosed to public authorities, offices and auditors.

f. Place of data processing
We also process your data outside the EU.
Due to the global nature of our company, we transfer data to our parent company in Switzerland. For Switzerland there is an adequacy decision of the EU, which can be accessed under Adequacy decisions | EU-Kommission (europa.eu). Likewise, for example, data is transferred to the USA via our third-party provider for cookies. Google is certified under the EU-U.S. Data Privacy Framework. The relevant information can also be accessed under Adequacy decisions | European Commission.
In the event of a data transfer to a third country for which there is no adequacy decision, we ensure that the protection of personal data is guaranteed by appropriate safeguards, such as the new standard contractual clauses. g. Obligation to provide data
In principle, you are not obliged to provide your personal data.
Where the legal basis for the respective processing is Art. 6(1)(b) GDPR, your personal data is required for the performance or conclusion of a contract. Without the provision of your personal data, conclusion and performance of the contract is not possible in such cases. If personal data is not provided in cases of processing pursuant to Art. 6(1)(a) or (f) GDPR, the use of the respective services and offerings is not possible.

II. Processing activities
a. Website visit
Our online offerings serve to provide information about our company and our services, to conclude or initiate contractual relationships as well as to communicate and interact with our customers and prospects.
For these purposes, we also process personal data. The scope and legal bases of the data processing depend on the services requested by the user, the respective browser configuration and the scope of any consents given.

b. Contacting us
When you contact us by email or via a contact form, the data you provide (your email address and, where applicable, your name and telephone number) will be stored by us in order to answer your questions. We delete the data arising in this context once storage is no longer necessary, or we restrict processing if statutory retention obligations exist. The legal basis is our legitimate interest pursuant to Art. 6(1)(f) GDPR. Our legitimate interest lies in responding to your enquiries and thereby ensuring your satisfaction. Where applicable, in the case of contract-related communication required for the performance of a contractual relationship concluded with you or for the implementation of pre-contractual measures based on your request, processing is carried out pursuant to Art. 6(1)(b) GDPR.

c. Newsletter
In the regularly issued media release newsletter, we provide information about our products and services and share current information on various topics. We only send the media release to you if you actively register for this service. When you register for our newsletter distribution list, the personal data you provide there will be collected, stored and processed for the purpose of sending the newsletter. If you wish, you can unsubscribe from the newsletter at any time in various ways: by contacting us directly (see the contact details above) and via the “Unsubscribe newsletter” link included in every newsletter. The legal basis for sending the newsletter is your consent pursuant to Art. 6(1)(a) GDPR.

d. Job applications
Applications can be submitted via the careers page or through other channels. The controller is the company to which you apply. We process the data required for the procedure (e.g. contact details, qualification data and documents). Sources are in particular the documents you submit, recruitment agencies or professional profiles specified by you. The purposes of processing are the implementation of the application process, communication with you and the assessment of your suitability. The legal basis is Art. 6(1)(b) and (f) GDPR. With your consent, we will also consider your profile for other positions / talent pool and internal forwarding. Data is stored for the duration of the procedure and thereafter only in the case of statutory obligations or for the defence of claims, or where your consent has been given. You have the statutory data subject rights, including the right of withdrawal and the right to object.

e. Cookies and other web technologies
In order to improve communication and interaction with our customers and to optimise the user experience, we use various software solutions and web technologies, including third-party tools for web analytics and marketing as well as services for the integration of third-party content such as fonts, maps or videos.
Analytics tools are used to collect, measure and analyse data points such as visitor numbers, visitor sources, pages visited, time spent on the website or scroll depth. Marketing tools enable the targeted management and analysis of marketing activities (ad campaigns, affiliate advertising, multichannel analysis).
For reasons of ePrivacy and data protection, the use of such tools often requires the consent of the respective user. To obtain and manage the necessary consents in accordance with Section 25(1) of the German Telecommunications-Telemedia Data Protection Act (TDDDG) and, where applicable, Art. 6(1)(a) GDPR, we use a so-called consent management tool (see the following section).
Detailed information on the subject and scope of the respective consents and the data processing operations based thereon is made available to you directly via the cookie consent management.
Where consent is not required, the processing of personal data takes place on the basis of Art. 6(1)(f) GDPR for the purposes described, which at the same time represent the interests pursued by us or our partners. The collection of data for the provision of the website and the storage of log files are absolutely necessary for the operation of the website.

f. Cookie consent manager
For consent management purposes, we use a cookie consent manager. This tool helps us to manage cookies, but also to request necessary consent from you and, in line with your decision, to set, start or not start cookies. This is necessary in order for us to comply with our compliance obligations. The legal basis for the use of the cookie consent manager is Art. 6(1)(c) GDPR (fulfilment of legal obligations to obtain and document consents) as well as Art. 6(1)(f) GDPR in conjunction with Section 25(2) no. 2 TDDDG (our legitimate interest in the demonstrability and management of consents). Details of the data processing by the CMT can be found in the user interface of the tool.

g. Google Analytics
Google Analytics, a web analytics service provided by Google Ireland Ltd., is used on this website for reach measurement and optimisation of our online offering. Cookies and/or similar technologies are used for this purpose, which enable an analysis of the use of the website; in particular, usage data (e.g. pages viewed, click paths), device/browser data as well as truncated IP addresses (_anonymizeIp()) are processed. Processing is carried out on the basis of your consent (Art. 6(1)(a) GDPR; for access technologies, also Section 25(1) TDDDG). The consent also covers any transfer to the USA; Google is certified for this purpose under the EU-U.S. Data Privacy Framework. The truncated IP address transmitted by your browser will not be merged with other Google data.
Withdrawal / opt-out: You can adjust your consent at any time with effect for the future in the cookie banner. Further information from Google can be found at: Terms of Use https://www.google.com/analytics/terms/de.html and Privacy https://policies.google.com/privacy.

III. Customers and suppliers

The controller processes personal data for the purpose of managing the contractual relationship and the ongoing cooperation, for example managing contact persons, communication, maintaining contact and handling processes, or for providing information and direct marketing. Processing in this regard is based on Art. 6(1)(f) GDPR. The controller’s interest lies in managing and handling the joint contractual relationship, customer care, information services and advertising. Where a direct contract exists with the person whose data is processed, the processing of data described above in relation to the management of the contractual relationship – with the exception of advertising – is carried out on the basis of Art. 6(1)(b) GDPR. In individual cases, processing may also be carried out on the basis of your consent pursuant to Art. 6(1)(a) GDPR; in such cases we will expressly point this out and ask for your consent.

IV. External links

Where this website contains links to third-party websites (“external links”), such third-party websites and the content published there are the sole responsibility of the respective operators. Feintool has no influence on the current and future design or the content of the pages linked via external links. The inclusion of external links does not mean that Feintool adopts the content behind the reference or link as its own. Feintool will not continuously check the linked websites unless there are concrete indications of legal violations. If Feintool becomes aware of legal violations, such external links will be removed without delay.
